TERMS AND CONDITIONS OF AUCTION

It is the buyers responsibility to read the terms and conditions of the auction fully. By registering to bid, all bidders agree to the following terms and conditions:

1. Buyer's Premium & Fees

• A 15% Buyer’s Premium applies to all purchases and is added to the high bid amount (hammer price).
• Applicable sales tax will be charged unless the buyer provides a valid resale/exemption certificate.
• The Buyer’s Premium and Internet Fee (if applicable) are calculated on the final hammer price before any applicable tax.

2. Payment Terms

• Accepted forms of payment: Cash, wire transfer, cashier's check, good local check, or credit card. Credit cards are accepted up to $10,000 per invoice, with a 4% processing fee applied to any amount exceeding the required deposit. See further payment terms by invoice size below:
  • Invoices ranging from $1 to $1,000: The credit card on file will be charged in full at the conclusion of the auction. No credit card fee will apply.
  • Invoices over $1,000: A $1,000 non-refundable deposit will be charged to the credit card on file at the conclusion of the auction. The remaining balance must be paid within 48 hours via approved payment method. No credit card fee will apply to the deposit.
• Invoices will be sent via email to the registered email following the auction. You are responsible for checking your email. If you believe you did not receive an invoice email, please contact company within 24 hours. Note: invoices are normally sent within 2-3 hours after auction end.
• Payment is due within 24 hours of the auction close unless otherwise stated. No items will be released until payment is made in full. Failure to pay may result in forfeiture of deposit, no-pay fees (not to exceed the total invoice amount), cancellation of sale, permanent ban, and possible legal action.
• Credit cards may be charged automatically for outstanding unpaid invoices after 24 hours with 4% processing fee unless alternate arrangements have been made.

3. Pickup & Removal

• Pickup: see auction listing for pickup window.
• General item locations are provided in each lot description – please read carefully. For items not located at our main lot, the full pickup address will be provided after the invoice is paid in full.
• Purchases will only be released upon presentation of a paid email receipt. If someone is picking up items on your behalf, they must bring your paid receipt to the pickup location.
• Buyers are solely responsible for removal. Please arrive with sufficient help and equipment to load all purchases. Removal shall be at the expense, liability and risk of the purchaser.
• Buyers are responsible for all logistics including scheduling, rigging, breakdown, and transport.
• Items not picked up within 7 business days may be subject to storage fees up to $25 per item per day and may be considered abandoned without financial recourse.
• Auction company is not responsible for damage, theft, or weather-related losses after the item is deemed sold.
• No shipping services are offered by Auction Company unless otherwise stated

4. As-Is, Where-Is – No Warranties

• All items are sold “AS-IS, WHERE-IS” with no warranties expressed or implied.
• Descriptions, photos, videos, and listings are believed to be accurate and provided as a guide only and are not guaranteed.
• It is the bidder’s responsibility to inspect items prior to bidding to determine condition. No refunds or returns will be given for incorrect assumptions about condition or suitability.

5. Titles & Legal Transfer

• For titled assets, title will be registered in the name used to register for the auction unless prior arrangements have been made.
• Titles will be mailed after full payment clears, typically within 15 business days.
• Sales Tax will not be collected on titled vehicles, trailers, or campers. Buyer will pay any applicable taxes when registering with their local agency.

6. Internet & Online Bidding

• Internet bidding is provided as a convenience; the auction company is not liable for internet failure, connectivity or platform issues.
• All internet bidders must provide valid credit card information for registration; credit card verification amount is $250 (this is not a hold or charge).
• For online only auctions, soft-close and auto-extend bidding features may be enabled.
• Bidders are responsible for all bids placed under their account, whether by themselves or a third party.
• Bidding errors will not be reversed after a lot begins closing, no exceptions.

7. Inspection & Preview Times

• Items located at our facility will have an in-person preview during a designated time announced in the auction listing. All other items are available for inspection by appointment only or as otherwise stated.
• Buyers are strongly encouraged to inspect items prior to bidding. All items are sold as-is, where-is, with no guarantees or warranties.

8. Damage, Liability & Indemnification

• Buyers are responsible for any damage caused during pickup.
• Auctioneer and seller are not liable for injuries or property damage during inspection or removal.
• By attending or bidding, you release the auctioneer, staff, and sellers from liability and agree to indemnify them against claims.

9. Non-Delivery or Item Unavailability

• In the rare event an item cannot be delivered, the buyer’s sole remedy is a refund of the purchase price and applicable buyer's premium. No compensation will be given for travel, inspections, transport, or repairs.

10. Reserve Rights & Auctioneer Discretion

• All auctions are conducted with reserve unless otherwise stated.
• Auctioneer reserves the right to:
  • Reject or revoke bidding privileges.
  • Reopen bidding in case of disputes.
  • Modify catalog descriptions.
  • Combine or split lots.
  • Withdraw items at any time.
  • Sell items to backup bidders in case of default.
• Sellers/Auction Team reserve the right to bid and buy.

11. Default & Remedies

• If buyer fails to pay or remove items, the auctioneer may resell the item at buyer’s expense and pursue legal remedies for unpaid balances and damages.
• Auctioneer may pursue outstanding balances using any payment method on file.

12. Miscellaneous

• All sales are final.
• No chargebacks or stop-payments will be accepted.
• Any form of payment reversal, fraud, or dishonored check will be treated as non-payment and pursued accordingly.
• These terms constitute a legally binding contract upon registration and/or placing a bid.
• By registering to bid, you consent to receive communications from the auction company and its affiliates via email, phone call, and text message regarding auction updates, invoices, pickup instructions, future auctions, and other relevant notices. Standard message and data rates may apply.
• Due to unforeseen circumstances, we reserve the right to modify auction timelines, including but not limited to the auction date, closing time, inspection times, and pickup/removal schedule.

13. Firearms

• All firearm sales are subject to federal and state laws
• Valid ID and applicable FBI background check required
• If you fail the background check, $100 restocking fee will be charged and buyer's premium forfeited
  • Do Not Bid on Firearms if you are unable to legally take possession
• Firearms should be examined by a qualified gunsmith prior to use
• Shipment of Firearms is available
  • Must be shipped to an FFL

  • $50 Shipping Charge per Firearm will Apply
  • We do not ship anything other than firearms unless prior approval is given
