ONLINE BIDDING TERMS & CONDITIONS

By registering and/or bidding in this auction, each bidder agrees to the terms and conditions of the auction and acknowledges that the successful bidder will be required to execute the applicable Real Estate Purchase Contract, Addendum A, Addendum B, and any other documents required to complete the transaction.

Copies of the Purchase Contract and applicable addenda will be provided to the successful bidder following the auction and will govern the final terms of the transaction.

SELLER CONFIRMATION: Each property is being offered at public auction subject to seller confirmation. The highest bid does not automatically constitute acceptance by the seller. No sale is final until the seller has accepted the bid and the required purchase documents have been executed.

BIDDING: All bids are considered binding offers to purchase and may not be withdrawn after submission except at the discretion of the auctioneer. Bidders should not place a bid unless they are prepared and financially able to complete the transaction.

PURCHASE CONTRACT: The successful bidder will be required to execute the applicable Real Estate Purchase Contract, Addendum A, Addendum B, and any additional documents required to complete the transaction promptly following seller acceptance.

EARNEST MONEY: The successful bidder will be required to provide a $10,000 non-refundable earnest money deposit for each property purchased, due upon execution of the Purchase Contract. Earnest money will be credited toward the purchase price at closing.

FINANCING: The sale is not contingent upon financing, appraisal, the sale of another property, or any other contingency unless specifically stated otherwise in writing. Bidders are encouraged to arrange any necessary financing prior to bidding.

DUE DILIGENCE: All prospective bidders are encouraged to conduct their own inspections, investigations, and due diligence prior to bidding. Bidders should independently verify all information they consider material to their decision to purchase, including but not limited to acreage, boundaries, frontage, access, zoning, permitted uses, utilities, taxes, easements, restrictions, environmental conditions, and availability of governmental approvals.

PROPERTY CONDITION: Property is being sold in its present condition, subject to the terms of the applicable Purchase Contract and addenda. All photographs, maps, aerial images, boundary outlines, dimensions, acreage figures, traffic counts, utility information, zoning information, and other marketing materials are provided for informational purposes only and should not be relied upon as a substitute for independent verification.

AUCTIONEER AUTHORITY: The auctioneer reserves the right to reject any bid, determine bidding increments, resolve disputes between bidders, reopen bidding when deemed necessary, correct clerical or bidding errors, and make decisions regarding the conduct of the auction.

ANNOUNCEMENTS: Announcements, corrections, or updates made by the auctioneer prior to or during the auction may take precedence over previously published advertising or promotional materials. The final executed Purchase Contract and related addenda will govern the transaction.

REGISTRATION: The auction company reserves the right to require bidder verification, proof of identity, proof of funds, a bank letter, or other information before approving a bidder for online bidding.

AUTHORITY TO BID: By placing a bid, the bidder represents that they are legally capable of entering into a binding real estate transaction.
